TERMS OF USE AND REFUND POLICY

Disclaimer: ALL SALES OF DIGITAL PRODUCTS ARE FINAL AND NON-REFUNDABLE. By paying your invoice from Silvermist Designs through PayPal, you agree that you are purchasing digital non-tangible goods and as such are not entitled to a refund of said goods, regardless of the reason why.

ACCEPTANCE OF TERMS

1. In purchasing one of our Premade or Custom Book Covers, you (the client) are entering a lawful agreement.

2. The Client does not need to have signed any document for these terms and conditions to apply. If the Client commissions any service from Silvermist Designs, then the Client will be deemed to have accepted these terms and conditions in full.

3. This agreement is between Silvermist Designs and the Client/Purchaser of the book cover as the one who pays the invoice.

4. This includes eBooks, print books, paperbacks, hardcovers, dust jackets, audiobooks, accessories, etc., from here on out known as the ‘Book Cover.’

5. This agreement is entered into in good faith by both Parties.

6. The parties agree that all disputes arising under this agreement shall be resolved through mediation. If mediation fails, the dispute will be resolved by binding arbitration.

7. Any purchase from this website, order form, invoice, etc., from Silvermist Designs indicates the client’s acceptance of this agreement. The client also accepts and agrees to the terms described herein.

SERVICE RESTRICTIONS

8. Silvermist Designs does not provide any kind of service free of charge. Each commercial project comes with a payment that will be agreed upon between the client and Silvermist Designs prior to starting the project.

9. Silvermist Designs retains the right to decline projects of an offensive or political nature.

CONFIDENTIALITY

10. All client information and materials are considered confidential and will only be used by Silvermist Designs to provide a quote or complete a project. Client information and project materials will not be shared with any third party, unless the client requests otherwise.

11. The client agrees not to publish any project material to the public before the full payment is paid. The client can share draft materials with friends and family in order to receive feedback, but in no case should said draft materials be posted on the web.

LICENSE AND OWNERSHIP RIGHTS

12. Upon receipt of full payment, Silvermist Designs grants the client the exclusive license to use the final file(s) for the specific project agreed upon.

13. IMAGE LICENSING AND USAGE RIGHTS

* 13.1 Stock & Workflow: The images used are licensed from third-party vendors. Silvermist Designs utilizes a professional, human-directed digital workflow. All compositions are transformative and human-assisted, ensuring they do not trigger “AI-generated” content disclosures for retailers like Amazon KDP.

* 13.2 Usage Limits: The standard license includes print runs or downloads up to 500,000 units. Monitoring sales volume and securing additional licensing once this threshold is met is the sole responsibility of the Client.

* 13.3 Restrictions: The license is granted for book cover use only (eBook and Print). Images are not licensed for merchandising or standalone accessories. Extended licenses for such uses may be purchased for an additional cost.

14. If the client supplies Silvermist Designs with materials subject to intellectual property rights by a third party, the client will secure the appropriate rights to use the materials before directing the designer to incorporate them into the project. Should any intellectual property dispute arise involving materials the client provides, the client assumes full legal and financial responsibility.

15. The client has no right to alter the final file(s) in any way except to change the size for printing or digital display. If the client desires any alterations, they will contact Silvermist Designs. Additional payments may be required to make these alterations. Due to third-party licensing restrictions, Silvermist Designs is unable to offer PSD files with layers.

16. Silvermist Designs retains copyright and ownership of all design and draft materials. Additionally, Silvermist Designs retains the right to use the client’s final file(s) and name in Silvermist Designs’s portfolio and to market and promote Silvermist Designs’s services.

SERIES CONTINUATIONS

17. Definition: A “Series Continuation” is defined as a new book cover design that utilizes the existing typography, layout, and core background elements of a previously purchased Silvermist Designs cover to ensure brand consistency across a series.

18. Pricing Policy:

* 18.1 Standard Continuations: To reward returning clients, the price for each series continuation is capped at the original full price of the initial premade design. This covers title changes, color shifts, and swapping minor, similarly-shaped artifacts while maintaining the original layout.

* 18.2 Sale Items: If the original premade was purchased at a promotional or sale rate, the price cap applies to the original full price of the design rather than the discounted sale price.

* 18.3 Significant Revisions: If the client requests changes to the core layout, background composition, or a significant portion of the design elements, the project falls outside of a “Standard Continuation” and will be quoted at current standard custom rates.

19. Scheduling: Series continuations require a new booking. It is recommended that clients contact Silvermist Designs at least 2 months in advance of their required finish date to ensure availability.

PROOFING

20. In the case the project includes final file(s) that are printable, the client is fully responsible for proofing the file(s) provided by Silvermist Designs. It is strongly suggested that the client requests a proof from the printer before publishing or ordering any printable material. At no time will Silvermist Designs be held financially or legally responsible for any problems, costs, fees, or expenses incurred by the client as a result of using the final file(s) provided by Silvermist Designs.

PAYMENT

21. Silvermist Designs currently accepts payments exclusively via PayPal. All invoices must be settled within 48 hours of issuance, unless an alternative arrangement has been previously agreed upon. Invoices will be delivered electronically via email. Please note, for pre-made cover designs, non-compliance with the 48-hour payment period may lead to the book cover design in question being made available again for purchase.

22. If you have ordered a print book cover design and do not provide the final manuscript page count by the time of final payment, the contract will remain active and open. The final file for the print cover will be delivered within 7 business days once the final manuscript page count and all required printer specifications have been supplied by you. It is essential to provide the correct page count to ensure the spine width and overall dimensions of the print cover are accurate.

23. Silvermist Designs will not release finished files to the client or other parties until total payment has been received, and in the case of print book cover designs, the final manuscript page count has been provided. The payment is also final approval of the project, and, once all conditions are met, this contract will be considered fulfilled and thus, terminated.

24. Silvermist Designs retains the right to discontinue, withhold, or suspend services for any account should payments not be paid for a contracted job in the order specified in this agreement.

25. Failing to abide by the payment terms of this agreement will result in Silvermist Designs retaining the right to (re)use any draft material as wanted.

DELIVERABLES

26. All deliverables will be listed on your invoice and will be delivered via Google Drive after receipt of your final payment. * E-book files: High-quality 2700×1800 JPG and a low-resolution 1350×900 JPG. PNG or flattened PSD files may be provided for an additional fee. * Print files: Complete paperback/hardback layout (front, back, and spine) and a high-resolution, print-ready PDF.

ATTRIBUTION

27. By hiring Silvermist Designs and using the final file(s), the client agrees to provide credit on either the back cover and/or on the copyright page as follows: Cover design by Silvermist Book Cover Designs (or: Cover and book design by Silvermist Designs).

CANCELLATION AND REFUND POLICY

28. If the client chooses to cancel the project by providing written notice at least 7 days prior to the commencement of design work, the booking fee will be refunded in full. If the client cancels after the initial 7 days but before the project starts, the booking fee will be forfeited.

29. Should the client cancel after work has begun, they are obligated to pay up to 50% of the total estimated cost or an hourly rate of $50 USD (whichever is greater), in addition to incurred expenses. The client retains no rights to any mockups or design elements created.

30. In the unlikely event that Silvermist Designs cancels, the booking fee will be refunded in full.

31. Upon the completion of full payment and delivery of final file(s), there can be no refund whatsoever.

MOCKUP DESIGNS AND FEEDBACK PROCESS

32. Concept Approval and Revisions: The custom cover design package includes a total of five (5) rounds of revisions. * The Pivot: Upon delivery of the 1st Draft, the Client may request one (1) Major Change at no additional cost. * Refinement: Following a Major Change, the Client has four (4) remaining rounds for minor revisions. * Additional Charges: Major Changes after the first round or revisions beyond the fifth round will be subject to additional charges.

PRINT TEMPLATE AND PRINTER SPECIFICATIONS

33. Silvermist Designs is not responsible for errors resulting from incorrect or incomplete printer templates provided by the client.

34. If the client provides an incorrect template or requires manual adjustments to a generic template, additional charges billed at an hourly rate of $50 USD will apply.

LIABILITY

35. Silvermist Designs is not liable for incidental, indirect, or consequential damages of any kind, including loss of revenues or reputation.

ENTIRE AGREEMENT

36. These Terms and Conditions constitute the entire agreement between Silvermist Designs and the client. No additional promises or conditions apply unless confirmed by all parties in writing.
