Terms & Conditions
Disclaimer: TERMS OF USE AND REFUND POLICY: ALL SALES OF DIGITAL PRODUCTS ARE FINAL AND NON REFUNDABLE.
By paying your invoice from Silvermist Designs through Paypal, you agree that you are purchasing digital non-tangible goods and as such are not entitled to a refund of said goods, regardless of the reason why.
ACCEPTANCE OF TERMS
1. In purchasing one of our Premade or Custom Book Covers, you, (the client) are entering a lawful agreement.
2. The Client does not need to have signed any document for these terms and conditions to apply. If the Client commissions any service from Silvermist Designs, then the Client will be deemed to have accepted these terms and conditions in full.
3. This agreement is between Silvermist Designs and the Client/Purchaser of the book cover as the one who pays the invoice.
4. This includes eBooks, print books, paperbacks, hardcovers, dust jackets, audiobooks, accessories and etc, from here on out known as the ‘Book Cover.’
5. This agreement is entered into in good faith by both of the Parties.
6. The parties agree that all disputes arising under this agreement shall be resolved through mediation. If mediation fails, the dispute will be resolved by binding arbitration.
7. Any purchase from this website, order form, invoice or etc from Silvermist Designs, the client indicates acceptance of this agreement. The client also accepts and agrees to the terms described herein.
SERVICE RESTRICTIONS
8. Silvermist Designs does not provide any kind of service free of charge. Each commercial project comes with a payment that will be agreed upon between the client and Silvermist Designs prior to starting the project.
9. Silvermist Designs retains the right to decline projects of offensive or political nature.
CONFIDENTIALITY
10. All client information and materials are considered confidential and will only be used by Silvermist Designs to provide a quote or complete a project. Client information and project materials will not be shared with any third party, unless the client requests otherwise.
11. The client agrees not to publish any project material to the public before the full payment is paid. The client can share draft materials with friends and family in order to receive feedback if he/she wishes, but in no case should said draft materials be posted on the web.
LICENSE AND OWNERSHIP RIGHTS
12. Upon receipt of full payment, Silvermist Designs grants the client the exclusive license to use the final file(s) for the specific project agreed upon.
13. The images used in the book cover design are all licensed from stock photo vendors. The license for these images will be transferred to the client upon full payment. The client agrees to abide by the terms of any license agreement for any images purchased by Silvermist Designs through a third-party image provider for use in client’s project. The rights purchased for the book cover include the rights to print runs (or downloads) of up to 500,000 units. For books of over 500,000 units, additional licensing fees may apply. The client may not use the images for any purpose other than for the book cover design. The images used in the cover are not licensed for merchandising or other accessories. The client agrees to abide by the third-party vendors’ licensing terms. Extended licenses for such uses can be bought at an additional cost.
14. If the client supplies Silvermist Designs with materials subject to intellectual property rights by a third-party, the client will secure the appropriate rights to use the materials before directing the designer to incorporate them into his/her project. Should any intellectual property dispute arise involving materials the client provides, the client assumes full legal and financial responsibility.
15. The client has no right to alter the final file(s) in any way except to change size for printing or digital display. If the client desires any alterations, he/she will contact Silvermist Designs. Additional payments may be required to make these alterations. Due to third party licensing restrictions Silvermist Designs is unable to offer PSD files with layers.
16. Silvermist Designs retains copyright and ownership of all design and draft materials. Additionally, Silvermist Designs retains the right to use the client’s final file(s) and name in Silvermist Designs’s portfolio and to market and promote Silvermist Designs’s services.
PROOFING
17. In the case the project includes final file(s) that are printable, the client is fully responsible for proofing the file(s) provided by Silvermist Designs. It is strongly suggested that the client requests a proof from the printer before publishing or ordering any printable material. At no time will Silvermist Designs be held financially or legally responsible for any problems, costs, fees or expenses incurred by client as a result of using the final file(s) provided by Silvermist Designs.
PAYMENT
18. Silvermist Designs currently accepts payments exclusively via PayPal. All invoices must be settled within 48 hours of issuance, unless an alternative arrangement has been previously agreed upon. Invoices will be delivered electronically via email. Please note, for pre-made cover designs, non-compliance with the 48-hour payment period may lead to the book cover design in question being made available again for purchase.
19. If you have ordered a print book cover design and do not provide the final manuscript page count by the time of final payment, the contract will remain active and open. The final file for the print cover will only be delivered once the final manuscript page count has been supplied by you. It is essential to provide the correct page count to ensure the spine width and overall dimensions of the print cover are accurate. See ‘Print Template and Printer Specification’ terms below for more details.
20. Silvermist Designs will not release finished files to the client or other parties until total payment has been received, and in the case of print book cover designs, the final manuscript page count has been provided. The payment is also final approval of the project, and, once all conditions are met, this contract will be considered fulfilled and thus, terminated.
21. Silvermist Designs retains the right to discontinue, withhold, or suspend services for any account should payments not be paid for a contracted job in the order specified in this agreement.
22. Failing to abide by the payment terms of this agreement, will result in Silvermist Designs retaining the right to (re)use any draft material as wanted.
DELIVERABLES
23. All deliverables will be listed on your invoice and will be delivered via Google Drive after receipt of your final payment.
Files for e-book cover design are:
- A high-quality 2700×1800 JPG file formatted for an e-book cover and specifications of the Client’s publishing platform, and a low resolution 1350×900 JPG file.
- PNG or flattened PSD file may be provided for an additional fee.
Files for print book cover design are:
- A complete paperback/ hardback book cover design and layout of the front, back, and spine set to the specifications of Client’s printing platform.
- A high-resolution, print-ready PDF for one publishing platform.
ATTRIBUTION
24. By hiring Silvermist Designs and using the final file(s), the client agrees to provide credit on either the back cover and/or on the copyright page as follows:
- Cover design by Silvermist Book Cover Designs (or: Cover and book design by Silvermist Designs)
- Some photos may also require a credit line on the copyright page (or in the book for spot images). Client will be given the proper wording if that is the case.

CANCELLATION AND REFUND POLICY
25. If the client chooses to cancel the project by providing written notice to the other party at least 7 days prior to the commencement of the design work, the booking fee will be refunded in full. However, if the client cancels after the initial 7 days but before the actual start of the project, the booking fee will be forfeited.
26. Should the client decide to cancel the project after the design work has begun, the client is obligated to pay up to 50% of the total estimated project cost or Silvermist Designs’ hourly rate of $35USD (whichever is greater) for the time spent, in addition to any expenses incurred up to the point when work was halted. This fee is to compensate for costs incurred and potential lost billable hours. In the event of such a cancellation, the client will not retain any rights to mockups, comps, or any design elements that were created for the project. The client agrees to destroy any copies of these materials and acknowledges that they will not be used for any purpose.
27. Designer’s Right to Discontinue
Silvermist Designs maintains a consistent professional standard across all projects to ensure each cover is genre-appropriate, marketable, stylistically cohesive, and aligned with the Silvermist Designs brand aesthetic.
If at any point it becomes clear that the requested direction cannot be executed to those professional standards—such as concepts that are not visually suitable for the intended genre, rely on mismatched or inconsistent illustration styles, require design choices that would compromise marketability, or fall outside the designer’s stylistic strengths—Silvermist Designs reserves the right to discontinue the project.
In such cases, when the discontinuation is initiated by Silvermist Designs, the booking fee will be refunded in full, and all drafts or materials created will remain the property of Silvermist Designs.
28. Upon the completion of full payment and the delivery of the final file(s) there can be no refund whatsoever.
MOCKUP DESIGNS AND FEEDBACK PROCESS
29. The custom cover design package includes the provision of initial mockup designs and up to five rounds of revisions based on the client’s feedback. If after the fifth round of revisions, the client wishes to make major changes to the design, additional charges may apply. Major changes include, but are not limited to:
- Complete redesigns starting from a new concept or layout.
- Significant layout changes that alter the entire arrangement of elements on the cover.
- Replacing the primary images or graphics used in the design.
- Changing the color palette.
- Changing all the fonts or styles of text on the cover.
- Adding new major elements such as illustrations, logos, or complex graphics not part of the original brief.
- Removing significant elements that affect the overall design and composition.
- Changing the format from a paperback cover to a hardcover with dust jacket, which requires reworking the design to fit new dimensions and layout.
- The Artist will provide a quote for the additional charges, and the client must accept the charges in writing via email before further revisions are made.
PRINT TEMPLATE AND PRINTER SPECIFICATIONS
30. Silvermist Designs is not responsible for any issues, printing errors, or delays resulting from the client providing incorrect or incomplete printer templates. It is highly recommended that the client confirm all specifications with their printer prior to submitting the template to Silvermist Designs.
31. It is the client’s sole responsibility to provide Silvermist Designs with the correct print cover template supplied by their printer. This template must include accurate measurements, bleed areas, spine width, and any other specifications required by the printer.
32. If the client provides an incorrect template, any changes required to adjust the design to fit the correct template will incur additional charges. These charges will be communicated to the client, and work will only proceed upon written acceptance of the additional fees.
33. If the client’s printer provides a generic template that requires manual adjustments to measurements, spine calculations, or layout modifications to meet specific printing requirements, additional charges will apply. The cost for these adjustments will be quoted based on the complexity of the required changes, and the client must approve the charges in writing before the work continues.
34. Additional Charges: Any changes required due to incorrect templates or adjustments to generic printer templates will be billed at an hourly rate of $40. A time estimate will be provided where possible, and work will proceed upon written acceptance of the charges.
LIABILITY
35. Silvermist Designs is not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of revenues or profits, loss of business or reputation, or loss of data, in any way related to our services. Silvermist Designs is not responsible for any claim, loss, or injury based on errors or any other inaccuracies appearing on our site or in our clients’ written documents, including without limitation as a result of any breach of the terms and conditions of this agreement.
ENTIRE AGREEMENT
36. These Terms and Conditions constitute the entire agreement between Silvermist Designs and the client. No additional promises or conditions will apply, written or oral, unless otherwise specified and confirmed by all parties in hard-copy or e-signature.
